REGIONAL DEVELOPMENT AND CHALLENGES FOR THE LEGAL CONSTRUCTION OF NORTHEAST

Abstract

The Northeast is a concept that is crystallized in the unconscious of the Brazilian population, designating a geographically located portion of the national territory. This article proposes to revisit the construction of this concept from a political and legal perspective, showing the choices made in each historical period to provide the intended regional development through institutions such as Chesf, DNOCS, and Codevasf, among others. The conclusion points to possible ways to reinvent the region, mainly due to the concept of the Matopiba. The study follows Geolegal methodology by using a historiographical base of the legal facts (Brazilian legislation) to produce a geographical value (regional development of the Northeast).

    Doutor em Geografia (Universidade de Brasília - UnB), sendo mestre em Direito e em Geografia, ambos pela Pontifícia Universidade Católica de São Paulo - PUC/SP. É especialista em Energia (MBA, Centro Federal de Tecnologia do Rio de Janeiro - CEFET/RJ) e bacharel em Direito (PUC/SP). É advogado do Porto Advogados e Presidente da Geodireito (GD). Ocupou funções de gestão em diversas empresas, associações e órgãos públicos do setor elétrico, do aeroportuário e de concessões de rodovias. Atuou profissionalmente: (i) No governo, como assessor do Ministro da Secretaria da Aviação Civil (SAC/PR) e como procurador da Agência Nacional de Energia Elétrica (ANEEL); (ii) Em instituições, como Diretor Jurídico da Associação Brasileira das Concessionárias de Energia (ABCE), do Sindicato de Energia do Estado de São Paulo (SIESP) e da Associação Brasileira das Concessionárias de Rodovias (ABCR); (iii) Em escritórios de advocacia, foi sócio do Demarest Advogados; (iv) Em concessionárias de serviço público, foi gestor na Inframérica S.A (aeroportos de Brasília e Natal); na Light (energia, RJ) e na AES Eletropaulo (energia, SP); e (v) Foi professor de Direito da Energia na Universidade Candido Mendes (UCAM/RJ). Tem artigos e livros publicados sobre Direito Administrativo Geográfico e Direito da Energia.
