Resumo

Neste artigo propomos discutir alguns problemas que surgem em relação à tutela do direito do suspeito no Tribunal Penal Internacional para a ex-Jugoslávia. É nossa opinião que, ainda que certos direitos são garantidos no complexo Estatuto, a norma processual e a jurisprudência do Tribunal tem falhado na sua tarefa de garantir um processo justo ao suspeito.
