an analysis of the Brazilian Civil-Military Dictatorship (1964-1969) through criminal processes

This article examines the use of legal processes during the Civil-Military Dictatorship to understand how the regime manipulated the legislation of the military regime, between the years 1964 and 1969. The research seeks to explore how the legal-police system, at the service of a military regime, modified and shaped the laws to persecute those considered “subversives” and, based on the analysis of five processes of the IV Exército (Recife, Pernambuco), the work investigates how legislation, especially after AI-5, influenced the nature and volume of processes. It is structured in two parts: first, it offers a historical and legal overview of the period 1964-1969, detailing the context of the judicial processes and the laws that shaped political repression, with an emphasis on Institutional Act nº 5 (AI-5); then, it carries out a detailed analysis of five processes available on the Brasil Nunca Mais platform, to identify the control and legitimation mechanisms used by the regime, especially after AI-5.
