This paper intends to investigate: why the Democratic Constitutional State must to consider the poverty and lack of resources of people as a matter of distributive justice? The answer of this paper is that it has to do this to ensure equality and freedom for all. It must to ensure the validity of its two values, that make it democratic, legal and fair.
