ANÁLISE COMPORTAMENTAL DO DIREITO: UMA ABORDAGEM DO DIREITO COMO CIÊNCIA DO COMPORTAMENTO HUMANO APLICADA

Abstract

O artigo propõe uma nova abordagem para a ciência do direito intitulada análise comportamental do direito. A referida abordagem parte da redefinição do fato do dever-ser como sendo o que os analistas comportamentais chamam de regras, ou seja, conjuntos de padrões comportamentais complexos, os quais auxiliam os indivíduos a adaptarem seu comportamento às contingências ambientais humanas e não humanas, sem terem de se expor diretamente a tais contingências. O artigo continua explicando os fundamentos epistemológicos das referidas regras, com base nos quais é proposta uma estrutura formal para descrevê-las. Em seguida, o artigo analisa detalhadamente a estrutura das normas jurídicas em termos de suas regras constitutivas, classificadas em três grupos, a saber, premissas comportamentais relevantes, metas sociais e contingências jurídicas.
